Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of incompatible chemicals, cyanide solid or liquid solutions, and liquid acid solutions, that would produce Hydrogen Cyanide (HCN) gas if combined in an accidental spill or leak: At the Manufacturing Facility, 22-07 41st Avenue, Long Island City, NY On or about 9-29, 2005 a) In the basement, 3 x 55 gals of drums labeled "HCl" (a solution of Hydrochloric Acid) and 2 drums labeled "CN Strip" (a solution containing Sodium Cyanide) were located inside of a berm 57" x 82" x 5." Storage of both chemicals inside of the same containment berm would result in the mixing of liquids if the drums developed leaks. b) On the 4th floor, 3 x 15 gallons of ENE Brown Dip that contains Chromic Acid were stored 4 feet away from 6 containers of cyanide solids: 115 lbs of Copper Cyanide, 200 lbs of Zinc Cyanide, and approximately 115 lb containers of two more Zinc Cyanide, two more Copper Cyanide, and 1 Potassium Cyanide container. Abatement Note: Among other methods, one feasible method to abate this condition would be to store liquid acid solutions separately from cyanide liquid and solid solutions. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.
