Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of: a) A tow hook system, mounted on the rear of a ready mixer truck, exceeded its load rating while pulling another ready mixer truck that had become stuck in mud, exposing employee(s) to the hazard of being struck by a tow hook that may become unattached during pulling/towing operations. Some feasible acceptable methods to correct this hazard are: 1. Ensure that tow hooks will only pull loads not in excess of their rated capacity; 2. Ensure that the appropriate grade mounting bolts are used; 3. Implementation of a written policy and procedure detailing how and under what conditions one ready mix truck would be pulled by another; 4. Implementation of a maintenance program that would ensure proper repair by cleaning and inspecting for worn, damaged, missing parts or loose connections.
