Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being "struck-by" the DART Welding Machine when it moved. Employees were allowed to work in the area of the DART Welding Machine, between the tracks where a potential "struck-by" hazard existed without a system in place to warn them of potential movement of the machine. The DART Welding Machine Operator did not have a complete, continuous or unobstructed view of the area the machine was about to move to. This exposed employees to a potential "struck-by" hazard. Among other methods, one feasible and acceptable method to correct this hazard is to install a remotely operated control on the DART Welding Machine together with a switch that would trigger a bell, buzzer and/or flashing lights before the circuit that triggered the movement of the DART Welding Machine was activated.
