Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to injury due to inadequate lighting in and around an elevator. On or about June 3, 2004, there was inadequate lighting in and around elevator #95309, at the first floor level, in Building 2 at 153 Hamlet Avenue. Illumination inside of the elevator car was not in accordance with Section 3.4.5 of ASME A17.3-2002, Safety Code For Existing Elevators and Escalators. One feasible and acceptable abatement method is to provide illumination outside of the elevator at the first floor level as well as in the interior of the elevator car, in accordance with ASME A17.3-2002.
