Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards in the event the powered industrial truck tipped over, due to its lack of an operator restraint system (seat belts). Workroom Floor Cabinet Shop: a)The Hyster Electric Powered Industrial Truck was not equipped with operator restraints to keep operators restrained to the seat in the event that the machine tipped over, exposing the employees to serious crushing injuries. Among other methods, one feasible method to reduce this hazard is to: 1.Equip all powered industrial trucks with seat belts and ensure that the seat belts are adequately maintained. 2.Train operators to utilize the seat belts whenever they are operating the equipment.
