Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed burns, laceration, and fractures: (a)Tharco at 13400 E. 39th Ave., Denver, CO 80239: The employer did not ensure each employee assigned to work on the T-Lam had been provided appropriate, specific, and adequate training concerning the use of the machine. This hazard exposed the employees to hazards such as coming in contact with the hot fin and rotating gears and product. Abatement Note: Among other methods, feasible and acceptable abatement method to correct this hazard shall include the following: (1)Prior to permitting an employee to work as the operator of the T-Lam, the employer ensure that each employee has successfully completed the training required as discussed in paragraph (2) and (3) of this recommendation. (2)Develop a written training program for the T-Lam consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the employees), and evaluation of the employee's performance with the T-Lam. (3)The employer ensure each employee be trained to recognize the hazards associated with the T-Lam and to understand the procedures to prevent injury and report hazards to the appropriate manager to have the hazard abated. (4)All employee training and evaluation be conducted by persons who have knowledge, training, and experience to train others and evaluate their competence.
