Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by waste collection vehicles: a) On the route at Patterson Road - Employees working as residential waste collectors were riding on the rear riding steps while the McClain EZ Pak rear end loader waste collection vehicle, VIN IM2KQ0185CWM007161 was operated in reverse, on or about 4/8/04. One feasible and acceptable abatement method, among others, to correct this hazard is to prohibit employees from riding on the riding steps while the vehicle is operating in reverse, as specified in American National Standards Institute, ANSI Z245.1-1999, Mobile Wastes and Recyclable Materials Collection, Transportation, and Compaction Equipment Safety Requirements.n,
