Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Company pier: On or about June 11th 2010 and times prior thereto, employees were tieing up the owners boat to the company pier without having the proper training on recognizing and staying clear of caught between hazards. This condition exposed employees to crushing hazards that resulted in the death of one of its employees. Among other methods some feasible methods of abatement would be: Employer should have boater safety course to include caught-between, use of PFD's and line handling. Also employer could not allow workers to tie up vessels or use fenders when securing the vessel up to keep clearance between the pier and vessel.
