Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to electrical shock, caught in, struck by and fire hazards: (a)F/T Alliance: Employees exposed to electrical shock, fire, struck by, and caught in hazards by the employer not developing a written lockout/tagout (LO/TO) program for hazards in the workplace, to include (1) periodic inspection of the LO/TO energy control procedures (2) engineering equipment specific procedural steps for, but not limited to, the scope, purpose, authorization, rules, and techniques for the control of hazardous energy (3) release from LO/TO (4) shift or personnel changes, and (5) work performed on the vessel by outside personnel and contractors. (b)F/T Alliance: Employees exposed to struck by, caught in, and electrical shock hazards by two Tokai Headers (model PHC550L on machine #24, and model PHC550R on machine #160R) that were disassembled for maintenance and observed to be energized by a 208 VAC power source without any means of lockout and or tagout for the machine's controls and stored energy sources. (c)F/T Alliance: Employees exposed to struck by, caught in, fire, and electrical shock hazards by the employer not providing a complete inventory of lockout/tagout (hardware) devices to isolate and secure the vessel's hazardous energy sources for which the unexpected energization or start up of the machines or equipment, or release of stored energy, could cause injury to employees. NOTE: Among other methods, one feasible and acceptable method to correct the hazards is to develop and implement the vessel's written LO/TO procedures and equipment in accordance with the U.S. Code of Federal Regulations, Title 29, part 1910.147,"The Control of Hazardous Energy (Lockout/Tagout)."
