Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and caught-between hazards: On or about November 08, 2005 and time there after, at least five employees operated a Case 580k backhoe that did not have a service brake or parking brake capable of stopping and holding the equipment. When the service brakes were applied during use, the employees could not stop the backhoe. When the parking brake was applied, it did not hold the backhoe from movement. AMONG OTHER METHODS, SOME FEASIBLE AND ACCEPTABLE MEANS TO ABATE THESE HAZARDS ARE: a)Repair the service brake system to the manufacture's specifications, the requirements of The Society of Automotive Engineers (SAE) J237 and the International Standard ISO 3450:1996(E); b)Repair the parking brake system to the manufacturer's specifications, the requirements of The Society of Automotive Engineers (SAE) J237 and the International Standard ISO 3450:1996(E).
