Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to : Throughout the Pressure Pipe Plant located at: 1000 MacArthur Blvd., Grand Prairie, Texas. INSTANCE (a): On or about May 9, 2005 and at times prior to, the employer by not having a boom angle indicator on American Locomotive Cranes unit #43 serial# L-4204 and unit #53 serial# 8510LC4349, exposed his employees to the hazards of being crushed or struck-by the overturning crane. AMONG OTHER FEASIBLE AND ACCEPTABLE MEANS OF ABATEMENT TO CORRECT THIS HAZARD IS: 1) Provide a mechanical or electronic boom angle indicator for the operator to determine the correct boom angle for the load being lifted in accordance with ANSI B30.5 (1968) paragraph 5-1.9.1(b) and ANSI B30.5 (1995) paragraph 5-1.9.1(c). INSTANCE (b): On or about May 9, 2005 and at times prior to, the employer by disengaging the draw works clutch on the Unit# 43 American Locomotive Crane Serial# L-4204 exposed his employees to struck-by hazards AMONG OTHER FEASIBLE AND ACCEPTABLE MEANS OF ABATEMENT TO CORRECT THIS HAZARD IS: 1) Maintain the draw works clutch in accordance with the manufactures recommendation, pages 100, 140, and 141 of the American Locomotive Crane Company Operating and Maintenance Manual and ANSI B30.5 (1968) paragraph 5-1.6.4. INSTANCE (c): On or about May 9, 2005 and at times prior to, the employer by removing the front windows from the American Locomotive Cranes, unit #24 serial# L-4249; unit #43 serial# L-4204; and unit #53 serial# 8510LC4349, exposed the employees to struck-by hazards from flying material or debris. AMONG OTHER FEASIBLE AND ACCEPTABLE MEANS OF ABATEMENT TO CORRECT THIS HAZARD IS: 1) Install the front windows in the cab of the crane as required by ANSI B30.5 (1968) paragraph 5-1.8.1(b).INSTANCE (d): On or about May 9, 2005 and at times prior to, the employer by not ensuring all of the lower load block sheave guards were in-place on the unit #43 American Locomotive Crane serial# L-4204, exposed his employees to a struck-by hazard. This hazard is substantially similar to the hazard cited in inspection number 305461246, citation 2, Item 1(a), issued on 01/15/2003. AMONG OTHER FEASIBLE AND ACCEPTABLE MEANS OF ABATEMENT TO CORRECT THIS HAZARD IS: 1) To ensure the rope dose not become fouled during slack conditions, maintain all load block sheave guards in accordance with ANSI B30.5 (1968) paragraph 5-7.7.4(c). INSTANCE (e): On or about May 9, 2005 and at times prior to, the employer by not ensuring the lower load block sheaves on the Unit #14 American Locomotive Crane serial# J3363 formed a close- fitting saddle for the size of rope being used, exposed his employees to a struck-by hazard. AMONG OTHER FEASIBLE AND ACCEPTABLE MEANS OF ABATEMENT TO CORRECT THIS HAZARD IS: 1) Maintain the load block sheaves in accordance with ANSI B30.5 (1968) and B30.5 (1995) paragraph 5-1.7.4(a). INSTANCE (f): On or about May 9, 2005 and at times prior to, by not providing doors that were restrained from opening or closing during operation on the American Locomotive Cranes unit #unit #24 serial# L-4249; unit #43 serial# L-4204; unit #51 serial# L-3594; and unit #14 serial# J3363, the employer exposed his employees to a struck-by hazard and fall hazard of approximately 25-feet to the ground level. AMONG OTHER FEASIBLE AND ACCEPTABLE MEANS OF ABATEMENT TO CORRECT THIS HAZARD IS: 1) Restrain the operators cab doors from inadvertent opening and closing by replacing or repairing the latch mechanisms in accordance with ANSI B-30.5 (1968) paragraph 5-1.8.1(c).
