Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: On or about 02/03/05, employees painting turning arrows on a roadway surface without channelizing devices were exposed to being struck by a motor vehicle when working in a traffic zone. ONE FEASIBLE AND ACCEPTABLE MEANS OF ABATEMENT TO CORRECT THE HAZARD: Follow Part 6 of the Manual on Uniform Traffic Control Devices. The company truck was blocking one lane of traffic and had protective cones around it. Employees could have parked on an adjacent street and used the cones to protect the lane in which they were working.
