Labor and Employment Article, Section 5-104(a), Annotated Code of Maryland: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)Date of Violation:06/02/04 Location:Roadway in Front of House Condition:An employee was standing on the back of a flat bed truck making a U-turn in preparation of setting work zone cones on the roadway. Among other methods, one feasible and acceptable abatement method to correct this hazard is to have the employee walk to the area where the work zone is to be set up or travel while seated in the cab of the vehicle. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
