P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the rotating superstructure or the boom or bucket of an excavator: A) Front area of building site - The operator did not ensure that the operational path of the Caterpillar 325C excavator was clear of personnel and equipment (water pump) prior to movement and the employees working in the area were not informed to stay out of the path during operation. One feasible and acceptable abatement method to correct this hazard is to train operators to ensure that the operational path of heavy equipment is clear prior to movement and train employees to stay out of the path of the equipment. In addition, establish a progressive disciplinary policy to enforce compliance.
