Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: On or about February 12, 2004, employee(s) were exposed to the hazards associated with falling with and or being struck by a Mark Industries scissor lift at heights up to 30' due to operation on uneven surfaces creating a potential for tipover conditions. Among other methods, one feasible and acceptable abatement method to correct this condition would be to develop and implement a program for the operation of scissor lifts in accordance with ANSI/SIA A92.6-1990 "Manual of Responsibilities for Users of Self- Propelled Elevating Work Platforms" or the manufacturer (Mark Industries) operator's manual to ensure that operators receive training in the hazards associated with and proper operating methods for scissors lifts, including but not limited to vehicle stability issues and avoidance of elevating lifts on uneven or sloped surfaces.
