Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: fall hazards and other serious hazards from employees standing on the forks of a rough terrain forklift to gain access to the third floor. a. On or about March 29, 2004-at the above addressed jobsite, Employees performing material handling from the Gradall Model 544D-10 rough terrain forklift were exposed to injuries from falls due to the lack of fall protection while riding the forks. Among other methods, one feasible and acceptable abatement method would be to comply with the ASME/ANSI B56.6-2002-section 5.15 (Elevating Personnel) for all rough terrain forklift trucks. Also, employees should be provided a personnel platform which complies with the design requirements listed in Part III of this standard.
