Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by parts or equipment: (a) Press Department, On or about 7/15/04 - An employee was fatally injured while repairing a spring and cylinder for a Caterpillar front end loader, using a Lempco H-Frame 50-ton hydraulic press. The employer had not assessed and controlled the hazards for the task being done on the press. ABATEMENT DOCUMENTATION AND CERTIFICATION REQUIRED Among other methods, one feasible and acceptable method to correct this hazard is to assess and control the hazards associated with operating the press and to provide a shield with sufficient strength to withstand the energy as part of the safeguarding system.
