Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being ejected from mobile equipment as it rolled over: (a) On or about May 26, 2004 - The operator of the Daewoo lift was not wearing the seat belt that was installed on the lift. (b) On or about May 26, 2004 - The operator of the Gradall rough terrain fork lift had the seat belt attached loosely around him, creating the hazard that the employee could be ejected from under the seat belt.
