Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls: a) Lyons & Sons Warehouse, 875 Sherman Avenue, Pennsauken, NJ - Employees were exposed to a fall of up to approximately 16 feet when they climbed stacked pallets of cocoa beans to access the top of these stacks in order to drop a fumigation tarp in place. On or about May 13, 2004. Feasible and acceptable abatement methods to correct this hazard include, but are not limited to, the following: 1. Automatic or manual tarping system. 2. Ensure that ladders are safely used to access the top of these stacks. 3. When on top of these stacks, provide a personal fall arrest system. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
