Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to kick back, struck-by and cut hazards while using a cut-off saw to cut an unsupported work piece. On or about 10/06/04, employees working inside an excavation were exposed to kick back, struck-by, and cut hazards when operating a gas driven saw to cut a clay pipe without supporting the conduit in a way that would prevent the diamond abrasive wheel from being pinched. Among other methods of abatement, feasible and acceptable methods to correct these hazards are: (a) to prevent the abrasive wheel from being pinched and subsequent tool kick back by supporting the pieces/sections being cut in a way that the cut remains open during and after such cut is completed; and (b) to follow all the manufacturer's safety precautions as outlined in the operator's manual of the cut-off saw.
