Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught between an crushing injuries: (a)Located at SW 137 Ave and SW 73 Ter, Miami, Florida - Deere wheeled loader/backhoe - On or about 08/17/2004, the worker was exposed to being crushed and cut in half when he rode in the bucket of the excavator into the trench. Among other methods, one feasible and useful method would be to prohibit employees from placing their bodies in the buckets of heavy equipment and to use a ladder to access and egress the excavation.
