Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to having their head and torso entrapped between the fork litf truck and ground in the event of tip over: a) On or about 5/14/04, the employees operating the two Toyota frok lift trucks were not required to wear the seatbelts that were provided on the trucks. Among feasible methods to abate this hazard is to comply with the American National Standard Institute (ANSI) Safety Standard for Low Lift and High Lift Trucks, ANSI B56.1- 1988, Section 5.3.19 and wear seatbelts at all times when operating the trucks.
