Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposure to being struck by debris and/or parts of the pneumatic presses (guillotine cutters) that explode due to a lack of preventative maintenance in that: (a)On or about October 29, 2003, operators were exposed to being struck by exploding debris and/or parts from the #29 guillotine cutter, SN. E-50K-543 when the pneumatically pressurized cutter exploded during operation as a result of loose parts. (b)The regulator gauge used to read the pneumatic pressure on the #29 guillotine cutter was broken. Among feasible method of abatement is to establish a preventative maintenance program that would include regular and periodic inspections that would ensure that parts of the equipment such as but not limited to nuts, bolts, and other fittings, when loosened during setups, maintenance and/or cleaning of the machines, are reinstalled and secured,as well as checked and maintained properly torqued prior to operation of the guillotine cutters.ne
