Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of contact with a rotating saw blade and flying objects: a) The Omega radial saw was equipped with a toggle-type motor starter switch that was not protected against unintended actuation by the normal movement of the machine operator or work as prescribed by the American National Standards for Woodworking Machinery, ANSI 01.1- 1992, Section 4.4.1.2. The machine was used during the period between July 9, 2003 and January 9, 2004. A feasible means of abatement would be to provide a motor switch that meets the requirements of ANSI 01.1-1992. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
