North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall from an unapproved platform: a)job site - where employees were working on an "unapproved" 7'X18" "Hydro Mobile" platform attached to a Terex Handlers Square Shooter (model SS-842, S/N 991835) extendible-boom forklift. Among other methods, one feasible and acceptable abatement methods to correct this hazard is to use appropriately designed personnel lifting equipment such as scissors-lift type vehicles or bucket trucks. Reference: ASME B56.6-1992, Paragraph 5.15.1(a): "Provide a personnel platform which complies with the design requirements listed in Part III of this Standard."ts
