Labor and Employment Article, Section 5-104(a), Annotated Code of Maryland: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:11/19/03 Location:Inlet Side of Culvert Condition:Employees were working in a culvert 7 feet to 10 feet in diameter, 2,388 feet long on a day when flash flooding conditions were predicted. Among other methods, one feasible and acceptable abatement method to correct this hazard is to develop and implement a program to monitor weather conditions to ensure that employees are removed from the culvert and adjacent work areas when physical hazards such as flash floods could occur. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
