Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Being struck by or caught in between the roll over protection and the ground in the event the employee falls or gets thrown off. The employee operating the Lull Highlander Two Forklift, model 844C-42, was exposed to being caught in between/crushed from not using the installed seat belts. On or about September 16, 2003 at the worksite located at the Juvenile Detention Center, off Hwy 65, in Dermott, Arkansas the employee operating a Lull Highlander Two Forklift, Model 844C-42, was not wearing the installed seatbelt. Among other methods, one feasible and acceptable abatement method to correct his hazard is to train/certify and inspect employees on wearing seatbelts installed by the manufacturer of the Lull Highlander Two Forklift.
