Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while using Marklift scissors lift in a manner inconsistent with the manufacturer's instructions: (a)JELD-WEN Hawkins Window Division 811 Factory St. Hawkins, WI: Employees were exposed to fall hazards while operating the Marklift scissors lift that had been modified by attaching two utility shelves on the outside of the basket. Both of the shelves were on the same side changing the center of gravity, without the manufacturers written authorization or certification. Abatement certification required for this item.
