Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing and/or caught between hazard when operating the skid-steer equipment: (a)Nursery Facility - The employer did not prevent untrained, unauthorized employees from operating the skid-steer equipment. ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS, TO CORRECT THIS HAZARD IS TO: RETRAIN ALL SKID- STEER OPERATORS IN THE SAFETY ASPECTS OF EQUIPMENT OPERATION, INCLUDING ALWAYS FASTENING THE SEAT BELT AROUND THE OPERATOR WHEN USING THE MACHINES AND ALWAYS LOWERING THE LIFT ARMS AND ATTACHMENT TO THE GROUND OR RESTING THE LIFT ARMS ON THE BOOM STOPS BEFORE EXITING THE SKID-STEER; PROVIDE TRAINING MATERIALS AND OPERATING MANUALS IN THE NATIVE LANGUAGE OF THE OPERATORS; ENSURE ALL OPERATORS UNDERSTAND THAT ONLY AUTHORIZED AND PROPERLY TRAINED EMPLOYEES ARE PERMITTED TO USE THE LOADERS; ENSURE ALL TRAINING COVERS THE 33 ITEMS CONTAINED IN THE SAFETY INFORMATION SECTION OF THE MANUFACTURERS MANUAL; AND, CONTROL ACCESS TO THE SKID- STEERS, TO INCLUDE ENSURING THAT OPERATORS REMOVE THE KEY BEFORE LEAVING THE SKID-STEER.RS
