Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck-by or crushed-by hazards: a.At 20310 Highway 216 McCalla, AL - On or about October 20, 2003 - Employee(s) was exposed to struck-by and crushed-by hazards when the restraint device on the Terex Rough Terrain Forklift was not utilized. Among other methods, one feasible and acceptable method would be to ensure that all forklift operators engage the restraint devices provided on the forklifts.
