Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) At the jobsite, two employees were exposed to an approximate 12 foot fall hazard in that, the employees were lifted by a Lull 844C-42 rough terrain forklift, serial number T2486V717, without the use of an approved personnel platform. Violation observed on or about 10/10/03. One means of feasible abatement to correct this hazard is to comply with the requirements of the American Society of Mechanical Engineers document ASME/ANSI B56.6-1987, Section 5.15, Safety Standards for Rough Terrain Forklift Trucks.t
