Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to unexpected energization and de-energization of electric circuits. a)At the construction site, World Trade Center Site, New York, NY On or about October 24, 2003 Employees were falling, tripping, being locked in an elevator when the power was locked out in the areas they were working. Employees working in the PATh tunnels, in temporary PATH station and other areas of PATH reconstruction site were not notified nor aware that the power was turned off while they were working. Among other methods, feasible and acceptable methods to correct this hazard is to: a) Follow the NFPA 70E, procedures for affected and authorized employees working on and in areas affected by a lock out tag procedures. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
