North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard. a) worksite - an automotive lift that, which did not have a manufacture installed safety catch br installed ( approximately 40 years old ) was operated uder capicity or near capicity load while a leak occured in the hydraulic over air system that was used to operate the lift. The lift was shored up with up 4 " x 4 " wooden post to prevent the lift and load from falling on the employee working under and near the lift.
