Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee was exposed to a falling tree: a) Jobsite at 85 Pine Forest Lane, Haines City, FL - A 17 inch diameter tree being removed was not notched using a conventional, open-face or Humboldt notch cut, on or about 8/23/03. ONE FEASIBLE AND ACCEPTABLE METHOD OF ABATEMENT WOULD BE TO: Follow the 2000 Edition American National Standard Institute Standard Z133.1-2000, for Arboricultural Operations - Pruning, Repairing, Maintaining, and Removing Trees, and Cutting Brush - Safety Requirements, under Tree Removal 9.5.15.1, which states "The notch cut used shall be either a conventional, open-face or Humboldt".
