Section 5 (a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were operating forklift trucks without wearing the seat belt exposing them to potential crushing injuries. Warehouse: Employees operating the two Toyota and two Hyster forklift trucks did not use seatbelts. One method, among other methods, to correct the condition, is to establish work rules requiring the use of seatbelts, train the employees on the work rules, and enforce the work rules.
