Section 5 (a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were operating forklift trucks without wearing the seat belt exposing them to potential crushing injuries. Establishment: The Clark forklift truck was not equipped with a seat belt exposing employees to potential crushing injuries. One method to correct the condition is have the manufacturer or his representative install a seat belt onto the forklift truck.ft
