Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: struck by, caught between/crushing hazards. a) Newark Liberty International Airport, Newark, N.J. - North area of airport, between Taxiway "Z" (Zulu) and Runway 11/29; The employer failed to adequately check the path and slope that a CMI PR-800-7/12, Profiler/Reclaimer (i.e. milling machine) was backing onto. One side of the machine was driven from a lower elevation onto a higher elevation, however the side to side slope of the machine's mainframe, exceeded the manufacturer's safety warnings and limitations. Among other methods, one feasible and acceptable abatement method to correct these hazards is to comply with the CMI's Operation, Maintenance & Service Manual Section 1, Page 2 and page 12 which warns users of the machine: 1) Not to exceed the side to side slope of the machine's mainframe beyond an 8.5 degree of angle, i.e. or a 15slope, because the machine may roll resulting in personal injury or death. 2) Require employees to read and follow the Operations Manual Section 1 - Operating Procedures to avoid a condition which could lead to tipping when working on hills, banks or slopes, and when crossing ditches, ridges or other obstructions.
