Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard while accessing the scissors lift: Elevated work platforms used with Rough Terrain Forklift Trucks as designated by the manufacturer must meet design, construction, and use requirements as outlined by American National Standard Institute ASME/ANSI B56.6-2002 Safety Standard for Rough Terrain Forklift Trucks Section 5.15.1(u): personnel did not maintain firm footing on the platform and were not secured by body belt and lanyard. (a)On August 5, 2004, employees of Pro-Type Builders, Inc. were observed using the midrail to access a scissors lift MEC 33RT from a beam above. Among other methods, feasible and acceptable means to correct these hazards are to use a safer alternate method such as extending the scissors lift to an appropriate height, provide additional training and use of the scissors lift according to the manufacturer's specification.
