Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Falls or possible amputation from the bucket attachment of an excavator being lowered into a trench approximately eight feet deep. (a) An employee was lowered into a trench approximately 8 feet deep in the bucket attachment of the excavator. The employee was exposed to a crushing injury between the bucket and the trench walls and/or fall hazard. This operation did not conform with the "Construction Industry Manufactures Association(CIMA): Section 16;" Never allow anyone to ride the attachment or the load". Among other methods, feasible and exceptable means to correct the hazard by use of a ladder in a properly shored, sloped or otherwise protected area in the trench. DORNER-STAHL INC.
