Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: A crushing injury/death when platforms lifts were put into service without adequate repairs. The platform lift was not maintained, documented and repair in accordance with the acceptable requirements of the American National Safety Standards for Self Propelled Elevating Work Platforms; ANSI/SIA A92.6-1999 Section 7.4-Replacements parts: When parts or components are replaced, they shall be identical or equivalent to original aerial platform parts or components. (a) On and prior to 04/03/04, the Marklift platform lift replacement parts installed on the control lever were not equivalent or identical to the manufacturers parts and/or repaired according to the manufacturers specifications. (b) On or about 03/26/04, the Marklift platform lift up/down control was repaired with parts other then the equivalent of the manufacturers. Among other methods, feasible and acceptable methods to correct the hazard: All replacement parts used and repairs should be equivalent to the manufacturers specifications. Abatement Certification required.
