Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards from dehydration system: a.On or about August 18, 2003, the Heil Dehydration System exploded causing the system to blow apart. The employer had not repaired or replaced parts of the system, such as the pilot burner (igniter assembly), that were in poor repair. Among other methods, one feasible and acceptable abatement method to correct this hazard is to repair and/or replace parts when needed, to develop and implement an inspection, testing and maintenance program in accordance with National Fire Protection Association 654, "Standard for the Prevention of Fire and Dust Explosions from the Manufacturing, Processing, and Handling of Combustible Particulate Solids", and operate and maintain equipment in accordance with the manufacturer's specifications.
