Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm to employees in that employees were exposed to possible fall, crush and amputation hazards while working from a platform on the elevated forks of a powered industrial truck. The platform a) was not rated and labeled for maximum load capacity of personnel and equipment, weight of the empty platform, and minimum capacity of the powered industrial truck it could be used with and b) was not guarded on the mast side to prevent employees from getting caught in moving parts. An employee worked at a height of approx. 15-18 feet from a platform attached to the elevated forks of a lift truck while changing overhead lights. a)No manufacturer's information was available for the platform and it was not labeled with the following capacity ratings: 1)maximum load, including personnel and equipment 2)weight of empty platform 3)minimum capacity of truck on which the platform can be used b)The side of the platform next to the forklift mast was not sufficiently guarded to prevent employees from contacting moving parts. One feasible means of abatement would be to comply with the American National Standards Institute/American Society of Mechanical Engineers Standard ANSI/ASME B56.1-2000 "Safety Standard for Low Lift and High Lift Trucks," Sections 4.17 and 7.36.
