Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: a. "At Isla Caja de Muerto". Agravation of injuries/illness due to the lack of transportation facilities (stand by motor boat) to move employees to a Ponce dock in case of accident or sickness. Employees are carried to the island every shift and the transportation facility returns to Tallaboa Dock. Among other methods, one feasible and acceptable abatement method to correct this hazard is to maintain a motor boat at Caja de Muerto dock to provide inmediate and continuos (day and night) transportation facility for employees in case of emergencies. a. En la Isla Caja de Muerto. Agravamiento de lesiones y enfermedades debido a la falta de facilidades transportacion (lancha de reserva) para mover los empleados aun puerto del area de Ponce en caso de accidente o enfermedad. Los empleados son llevados a la isla en cada turno y el medio de transportacion regresa al muelle de Tallaboa. Entre otros metodos, uno factible y aceptable para corregir este riesgo es mantener una lancha en el muelle de Isla Caja de Muerto para tener un medio de transportacion inmediata y continua para los empleados en caso de emergencia.
