Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: being crushed by the Case Model 1840 Skid Steer Uniloader due to the lack of an operable horn and an operable reverse signal alarm. (a)Proposed Wendy's Restaurant, 7521 North Washington Avenue, Ocean Springs, MS- Employees were exposed to being struck by the Case Model 1840 Skid Steer Uniloader which did not have an operable horn, nor an operable reverse signal alarm. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO: 1. ensure that all installed equipment is operational; 2. if not already installed, install an operable horn and reverse signal alarm.
