Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that operator and a passenger were allowed to ride on an Honda ATV. The long seat is designed to allow the rider to change body position, not for carrying a passenger. The employees were exposed to hazard of being unable to balance and control the ATV resutling in a crash. (a)Highway 305 at Lewisberg, MS - Honda 4-wheeler ATV on December 20, 2004 was being operated by a operator with a passenger. Among other methods, one feasible and acceptable method to correct this hazard, includes but not limited to: (1) Never let a passenger ride on the seat.
