Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: Hazard of being thrown from a forklift being operated without a seatbelt. (a)Throughout Faciltiy - Yale forklift was not equipped with a seatbelt. Yale forklift was being operated throughout the facility loading and unloading products and materials in the warehouse. Among other methods, one feasible and acceptable method to correct hazard is to ensure that powered industrial trucks are retrofitted with seatbelts and employees are trained and required to utilize the seatbelts during operation.
