Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: crushing injuries from a forklift overturning. (a)Midstream Fuel Service, Pascagoula - The operator restraint system (seat belt) provided on the forklift was not being used by the operator of Nissan 90, WGF03A40V Type D Powered Industrial Truck (Serial No. WGF03-920857) during the period September 1, 2004 through September 18, 2004. Among other methods, one feasible and acceptable method to correct this hazard is for the employer to require and effectively enforce the use of the operator restraint provided by the manufacturer of the forklift.
