Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed drowning. (a)Bean Dredging LLC- Employer failed to maintain derrick barge AB-1116 in that the hull was cracked permitting the barge to take taking on water resulting in the barge capsizing. Among feasible and acceptable abatement methods to correct these hazards includes but not limited to the following: 1. Maintain the barge to prevent it from taking on water and capsizing.
