Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the hazard of being crushed-by a forklift during a tip-over event while operating powered industrial trucks at Clearspan Components, Inc. without wearing seatbelts. The employer violated this section of the Act on or about March 15- 16, 2004, throughout the facility when Caterpillar forklifts identified as No. 454/TC30 was not retrofitted with a seatbelt; No. 460/VO259 had its seatbelt removed; and Hyster No. 457/80 was operated without its seatbelt secured. Among other methods, a feasible and acceptable method to correct this hazard is to ensure that powered industrial trucks are retrofitted with seatbelts and employees are trained and required to utilize the seatbelts during operation.
