Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: being crushed due to not wearing seat belts while operating equipment with roll-over protective structure(s). (a)ALAMISS, Inc. Sawmill - Operator(s) of the following log/lumber handling vehicles, which were equipped with roll-over protective structure(s) (ROPS), were either not wearing seat belts, or the seat belt was missing: (1) the John Deere 486-E forklift - Operator not wearing seatbelt. (2) the Volvo L90C log loader - operator not wearing seatbelt. (3) the John Deere 444-C front-end sawdust loader - seat belt missing. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide and ensure the use of seat belts on all equipment having a ROPS.
